On the first day of the new administration, an Executive Order (EO) was issued to realign the U.S. Refugee Admissions Program. While widely reported as a suspension of refugee resettlement, its effects extend beyond the tens of thousand of individuals still waiting overseas—it also impacts refugees already in the U.S.

This post highlights key implications for refugees currently residing in the country.

At the outset, it is important to note that policies are evolving quickly and we do not yet know how all changes will be implemented.

One of the most immediate and significant effects is the halt in processing of I-730 follow-to-join applications for certain family members of resettled refugees. This directly affects refugees who arrived in the U.S. within the last two years and are seeking to reunite with a spouse or unmarried children under 21.

Additionally, the EO has led to the suspension of resettlement agency support programs for newly arrived refugees, further complicating their transition and stability.

Despite these challenges, there are important steps refugees in the U.S. can take:

– Continue submitting I-730 petitions. Even though processing is currently paused, filing now ensures that your case is in line for review when processing resumes.

– Asylee I-730 petitions are thus far not affected. If you were granted asylum in the U.S. within the past two years, your ability to petition for certain derivative family members remains unaffected.

– Family-based petitions (I-130) remain an option. Refugees who have adjusted their status to lawful permanent residents (green card holders) may file I-130 petitions for eligible family members.

– Timely file for adjustment of status (I-485). Refugees who have been in the U.S. for one year should apply for permanent residency to ensure a defined and secure legal status.
