On Humanitarian Protection

Affirmative asylum is when you proactively apply for asylum with USCIS (US Citizenship and Immigration Services), regardless of whether you are in removal proceedings. Defensive asylum is when you request asylum as a defense against deportation or removal in immigration court proceedings.

If you have been granted asylum in the US, you may be eligible to file a Form I-730, Refugee/Asylee Relative Petition, for certain family members (spouse and children) who are outside the United States. If approved, your family members may be able to come to the US to join you as asylees.  There are specific eligibility requirements and deadlines for filing I-730 petitions.
